This website, www.onemodiamond.com (the “Website”), is owned and operated by FABJORO UAB, a company registered in Lithuania, with its headquarters at Vingrių g. 13, Vilnius, Lithuania and VAT registration number LT100007833715. By using this Website, including any transactions made through it, you agree to be bound by these Terms and Conditions. These Terms and Conditions also include our Return Policy, Delivery Terms, and Payment Conditions, all of which collectively form our “Terms and Conditions”. Please read these Terms carefully before using the Website, as your use of the Website signifies your agreement to comply with them. FABJORO UAB reserves the right to update or modify these Terms at any time. Any such changes will apply to new orders immediately upon publication on the Website. It is the customer's responsibility to review the Terms before making a purchase. Your continued use of the Website implies acceptance of the latest version of these Terms and Conditions. These Terms apply to all contracts you enter with us, including those made via remote communication methods, such as telephone or email, when you place an order outside of the Website.
1. GENERAL TERMS
1.1. These Terms and Conditions (hereinafter referred to as the "Terms") govern the use of the website www.onemodiamond.com (the "Website") and regulate the rights and obligations of both the customer (“Buyer”) and the seller (“One Mo Diamond” or “Seller”).
1.2. These Terms apply to all sales contracts, transactions, and interactions between One Mo Diamond and the Buyer, whether conducted via the Website, email, or telephone.
1.3. One Mo Diamond sells its products exclusively to: Individuals over 18 years old with full legal capacity Legal entities (companies, organizations, businesses) Minors (14-18 years old) with parental or guardian consent
1.4. By using the Website and placing an order, the Buyer confirms that they have read, understood, and agreed to these Terms.
1.5. The Seller reserves the right to refuse service, cancel an order, or restrict access to the Website if fraudulent or abusive activity is suspected.
2. SALES TERRITORY
2.1. One Mo Diamond sells and delivers products within the European Union (EU).
2.2. Orders outside the EU may be accepted at the Seller’s discretion. Additional shipping costs, customs duties, and taxes may apply to non-EU orders, which are the Buyer's responsibility.
2.3. The Seller reserves the right to restrict or refuse sales to certain countries if local laws, import restrictions, or logistical issues prevent successful delivery.
2.4. If an order is placed from a country where sales are not permitted, One Mo Diamond will inform the Buyer and cancel the order with a full refund.
3. ORDER PROCESS & CONTRACT FORMATION
3.1. Order Confirmation & Validity An order is considered valid only after full payment is received and the product is shipped to the Buyer. The Buyer will receive an order confirmation email, but this does not mean that the order is finalized. The sales contract is formed only when the product is prepared and shipped. If there are any stock availability issues, pricing discrepancies, or technical errors, One Mo Diamond reserves the right to cancel the order and refund the Buyer in full.
3.2. Order Cancellation Before Shipment An order can be canceled only before it has been shipped. If the order has already been prepared for shipment or handed over to the courier, it cannot be canceled. If the Buyer wishes to cancel an order that has not yet been shipped, a refund can be issued, but an administrative fee of 3% may be deducted to cover payment processing costs.
3.3. Pre-Order & Custom Orders If an item is not in stock, the Buyer may place a pre-order. The production time for pre-ordered items is 14 business days, plus shipping time. Once a pre-order is confirmed, it cannot be canceled or refunded, unless One Mo Diamond fails to fulfill the order within the agreed timeframe.
3.4. Price Adjustments Prices for already manufactured products do not change after the order is placed. In cases where a pricing error occurs, One Mo Diamond reserves the right to correct the price and notify the Buyer, who may choose to either proceed with the purchase or receive a full refund.
4. PRICING & PAYMENT
4.1. Pricing Policy All prices on www.onemodiamond.com are displayed in Euros (€) and include VAT applicable to the Buyer’s country within the European Union (EU). The detailed breakdown of taxes (VAT) and other applicable charges is provided in the final invoice sent to the Buyer after purchase. Prices are subject to change at any time before an order is confirmed. However, once an order has been placed and paid for, the price is final and cannot be adjusted.
4.2. Accepted Payment Methods One Mo Diamond accepts secure online payments via: Stripe Credit & Debit Cards (Visa, Mastercard, American Express) Apple Pay, Google Pay SEPA Bank Transfer (for EU customers) SEPA Direct Debit Advanced fraud protection (Stripe Radar) Mollie iDEAL (Netherlands) Bancontact (Belgium) Sofort (Germany, Austria, Switzerland) Trustly (EU-wide bank transfers) All transactions are securely processed via SSL encryption, 3D Secure (3DS) authentication, and fraud prevention technologies, ensuring maximum payment security. Cryptocurrency Payments One Mo Diamond also accepts payments in cryptocurrency, including Bitcoin and Ethereum. Crypto payments are manually verified and processed securely. Orders will be confirmed once payment is received in full.
4.3. Currency & Conversion All transactions on www.onemodiamond.com are processed in Euros (€). If the Buyer’s bank account operates in a different currency, currency conversion fees may apply, as determined by the Buyer's payment provider.
4.4. Taxes & Customs Duties For orders within the EU, VAT is included in the final price and will be displayed on the invoice. For non-EU countries (e.g., the UK, Switzerland, Norway), additional import taxes, customs duties, or handling fees may apply. The Buyer is responsible for paying any customs duties and import fees required by their country’s regulations. One Mo Diamond is not liable for these charges.
4.5. Payment Terms & Security All orders must be paid in full at the time of purchase. Payments are processed through Stripe and Mollie, ensuring compliance with strong customer authentication (SCA), 3D Secure (3DS), and fraud prevention technologies. One Mo Diamond reserves the right to cancel any transaction suspected of fraud or unauthorized activity.
5. SHIPPING & DELIVERY
5.1. Shipping Methods One Mo Diamond delivers all orders using trusted courier services to ensure fast and secure delivery. Standard shipping within the European Union (EU) is handled by DPD. For high-value orders, One Mo Diamond may use premium courier services such as UPS or DHL (subject to availability).
5.2. Estimated Delivery Times Standard shipping (DPD) within the EU: 3-5 business days Premium shipping (UPS/DHL, for high-value orders): 1-3 business days Non-EU deliveries: Estimated 5-10 business days, depending on customs clearance times. Delivery times are approximate and may vary depending on the destination and external factors such as customs clearance delays.
5.3. Shipping Costs A flat shipping fee of €35 applies to all orders within the European Union (EU). For non-EU destinations, additional shipping fees may apply depending on location and courier service.. This fee covers standard insured shipping via DPD, UPS, or DHL, depending on the value of the order and the delivery location. Any additional charges related to import duties or local taxes for non-EU destinations are the responsibility of the Buyer (see Section 5.6).
5.4. Shipment Tracking Each order is provided with a tracking number, which is sent to the Buyer via email after dispatch. The Buyer can track their shipment directly on the courier’s website.
5.5. Insurance & Liability All shipments are insured for their value until delivery is completed. Once the package is delivered to the specified address, signed for, or confirmed as delivered by the courier service,the responsibility transfers to the Buyer. If an order is lost or damaged during transit, the Buyer must contact One Mo Diamond within 48 hours of receiving the delivery notification.
5.6. Customs Duties & Import Fees For deliveries outside the EU, the Buyer is responsible for all customs duties, import taxes, and additional local fees. One Mo Diamond is not liable for delays caused by customs clearance.
5.7. Shipping Restrictions Orders cannot be shipped to P.O. Box addresses due to security reasons. Some countries may be restricted due to local regulations or courier limitations. One Mo Diamond reserves the right to cancel and refund orders to restricted locations.
6. RETURNS & REFUNDS
6.1. Return Policy Buyers have the right to return a product within 30 days from the delivery date. To be eligible for a return, the item must: Be in its original, undamaged packaging. Be unused and unworn, retaining its original appearance. All security seals, labels, and tags must remain intact and unremoved. Include all original certificates and purchase documents. Be returned in full set, including any additional accessories or packaging. Include a return authorization code provided by One Mo Diamond. The Seller reserves the right to reject returns if the Buyer does not comply with the return conditions or if the item is: Used, modified, engraved, resized, or damaged. Missing its original certificates, labels, or packaging components. Returned with a removed or tampered security tag. Without the return authorization code. If the original quality certificate is missing, One Mo Diamond reserves the right to charge an additional fee for re-certification or reject the return.
6.2. Non-Returnable Items The following items cannot be returned: Personalized jewelry, including engraved or resized pieces. Any product with a removed, broken, or tampered security tag.
6.3. Return Shipping & Costs The Buyer is responsible for all return shipping costs. Returned items must be shipped via registered mail with full insurance coverage equivalent to the item's value. One Mo Diamond is not liable for lost or damaged returns caused during transit.
6.4. Refund Processing Upon receiving the returned item, One Mo Diamond’s experts will inspect it within 3 business days to ensure it meets all return conditions. If approved, the refund will be issued within 14 business days from the date the return is received. Refunds are processed only to the original payment method and payer.
7. WARRANTY & REPAIRS
7.1. Warranty Coverage One Mo Diamond provides a 2-year statutory warranty covering manufacturing defects only. This warranty applies exclusively to structural or material defects that occur due to a fault in production. Natural wear and tear is not covered under this warranty.
7.2. Warranty Exclusions The warranty does not cover the following: Scratches, oxidation, or natural signs of wear from daily use. Damage caused by improper handling, excessive force, or impact. Loss of stones due to external physical damage or improper maintenance. Repairs, modifications, or resizing done by a third party – this voids the warranty. If the Buyer damages the jewelry, One Mo Diamond offers a paid repair service, ensuring high-quality restoration.
7.3. Free Resizing Service One Mo Diamond offers one free ring resizing within 30 days of delivery, provided that the design allows for resizing. If resizing is not possible due to the ring’s structure, One Mo Diamond will offer alternative solutions. Full eternity rings cannot be resized due to the continuous gemstone setting – in such cases, a new ring must be made. Some rings can only be resized up to a certain limit, beyond which a new ring must be produced. Plain solitaire rings can be resized up to 4 sizes up or down. Diamond-accented rings (halo, vintage, three-stone, eternity bands) can be resized up to 3 sizes up or down. Half eternity rings can be resized up to 2 sizes up or down. Engraved rings can be resized, but engraving may need to be redone (additional charges apply). If a resizing request exceeds these limits, the ring must be remade, and additional fees will apply depending on material and stone adjustments.
7.4. Paid Repair Services Beyond the warranty period, One Mo Diamond provides professional repair services for a fee. The cost of repair depends on the type and extent of damage. Customers can request a repair estimate before proceeding with the service.
7.5. Warranty Validation For warranty claims, the Buyer must present the original warranty booklet or other proof of purchase included with the product. Purchase invoices or receipts are not required for warranty validation, as all electronic purchases are recorded in the One Mo Diamond system.
8. DIAMOND & JEWELLERY CERTIFICATION
8.1. Certified Diamonds & Gemstones All diamonds of 0.30 carats or above sold by One Mo Diamond are certified by either GIA (Gemological Institute of America) or IGI (International Gemological Institute), ensuring authenticity and quality.
8.2. Precious Metal Hallmarking All jewelry pieces sold by One Mo Diamond are certified by the Lithuanian Assay Office, verifying the authenticity of precious metals. Lithuania is a member of the Hallmarking Convention, ensuring compliance with international precious metal control and consumer protection standards. 9. LIABILITY & FORCE MAJEURE
9.1. Liability One Mo Diamond takes full responsibility for the order until the moment it is delivered to the Buyer’s specified address. Once the package is delivered and signed for, responsibility for the product transfers to the Buyer. If the shipment is lost or damaged during transit, One Mo Diamond will assist in resolving the issue with the courier. One Mo Diamond is not responsible for: Natural wear and tear (scratches, oxidation, fading, or metal reactions over time). Incorrect handling, impact damage, or misuse of jewelry. Stone loss due to external physical force or improper maintenance. Any modifications, repairs, or resizing done by a third party – this voids the warranty (see Section 7.2). Delayed delivery caused by third parties, such as courier services or customs authorities. If the Buyer refuses a properly delivered package, no refunds will be issued unless agreed upon by One Mo Diamond.
9.2. Force Majeure One Mo Diamond is not liable for any delays, partial or full non-fulfillment of obligations caused by force majeure events, including but not limited to: Natural disasters (earthquakes, floods, fires, storms). Pandemics, epidemics, or health-related crises. Wars, riots, civil disturbances, or terrorism. Government-imposed restrictions, sanctions, or trade embargos. Supply chain disruptions, strikes, or labor disputes. If a force majeure event occurs: One Mo Diamond reserves the right to delay order fulfillment until the situation stabilizes. If an order cannot be fulfilled within a reasonable period, the Buyer will be offered a refund or an alternative solution.
10. INTELLECTUAL PROPERTY
10.1. Trademark Protection One Mo Diamond® is a registered trademark, and all rights to the brand name, logo, and associated branding elements are legally protected. Any unauthorized use of the One Mo Diamond name, logo, or branding materials is strictly prohibited and may result in legal action.
10.2. Ownership of Designs & Content All jewelry designs, images, texts, videos, product descriptions, and website content available on www.onemodiamond.com are the exclusive property of One Mo Diamond (FABJORO UAB). No part of the website content, including product images and descriptions, may be copied, modified, reproduced, resold, or distributed without prior written consent from One Mo Diamond.
10.3. Copying & Unauthorized Use All jewelry designs are original and protected by copyright law. Any attempt to copy, replicate, or counterfeit One Mo Diamond jewelry is strictly forbidden and will be subject to legal action.
10.4. Custom Designs & Client Contributions If a client submits a custom jewelry design, One Mo Diamond retains the right to manufacture and use the design for future production, unless otherwise agreed in writing. Any images, testimonials, or content shared by clients (e.g., on social media or via reviews) may be used for marketing purposes unless the client explicitly requests otherwise.
10.5. Legal Consequences Any unauthorized reproduction or commercial use of One Mo Diamond intellectual property will result in legal action under applicable Lithuanian, EU, and international intellectual property laws.
11. LIMITATION OF LIABILITY
11.1. General Limitation of Liability One Mo Diamond shall not be held liable for any indirect, incidental, or consequential damages, including but not limited to: Loss of profit, revenue, business opportunities, or savings. Emotional distress, reputational damage, or inconvenience caused by order delays or issues. Any third-party claims related to the purchase or use of our products. The only exceptions to this limitation apply if One Mo Diamond: Intentionally or negligently causes harm to the Buyer. Breaches essential contractual obligations, meaning those obligations required to fulfill the purpose of the contract.
11.2. Liability for Breach of Essential Contractual Obligations If One Mo Diamond breaches an essential contractual obligation, liability is limited to foreseeable damages that are typical for this type of contract. This does not apply if the damages result in injury to life, body, or health.
11.3. Exemptions from Liability Limitations The above limitations do not apply if: One Mo Diamond fraudulently conceals a defect in the product. One Mo Diamond explicitly guarantees a certain product quality that is not met. The case falls under applicable Product Liability Laws, which remain unaffected.
12. DATA PROTECTION & PRIVACY
12.1. Collected Personal Data One Mo Diamond (FABJORO UAB) collects and processes only the necessary data required for order fulfillment and customer service: Identification data: Full name, phone number, email address. Shipping details: Delivery address, city, postal code, country. Payment information: Bank transfer details, but One Mo Diamond does not store credit card data—all transactions are securely processed through Stripe and Mollie. Browsing data: IP address, device type, and browsing behavior (via cookies, if consented).
12.2. Purpose of Data Collection One Mo Diamond uses customer data for the following purposes: Order processing and fulfillment. Customer communication (e.g., order confirmations, shipping updates). Marketing communications, if the customer has opted in (e.g., promotional emails, newsletters). Improving website functionality and user experience through analytics tools.
12.3. Data Sharing with Third Parties One Mo Diamond does not sell customer data to third parties. However, data may be shared with: Logistics providers (DPD, UPS, DHL) for order delivery. Payment processors (Stripe, Mollie) for secure payment transactions. 13. VIRUSES, HACKING, AND OTHER OFFENSES
13.1. Prohibited Actions The Buyer and any user of the One Mo Diamond website must not: Introduce viruses, malware, trojans, logic bombs, or any other malicious software. Attempt to gain unauthorized access to the website, servers, databases, or any connected systems. Engage in denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks on the website. Any violation of these rules will be reported to law enforcement authorities, and One Mo Diamond will cooperate fully with investigations. This includes disclosing the offender's identity upon a valid legal request.
13.2. Disclaimer of Liability One Mo Diamond is not liable for: Any damages or losses caused by cyberattacks, including viruses, malware, or hacking attempts. Any corruption of the Buyer’s computer, software, or data due to the use of the website or downloads from the website. Any third-party websites that may be linked to www.onemodiamond.com. The limitations of liability stated in Section 10 apply to this clause accordingly.
14. GOVERNING LAW & DISPUTE RESOLUTION
14.1. Governing Law & Jurisdiction These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Lithuania. Any disputes, claims, or legal proceedings related to One Mo Diamond (FABJORO UAB) shall be subject to the exclusive jurisdiction of the courts of Lithuania. If any provision of these Terms is deemed unenforceable under Lithuanian law, the remaining provisions shall remain valid and in full effect.
14.2. Alternative Dispute Resolution (ADR) Before initiating any legal action, the Buyer must first contact One Mo Diamond's customer support at info@onemodiamond.com to attempt to resolve the dispute amicably. One Mo Diamond commits to responding to all complaints within 5 business days and making reasonable efforts to resolve any disputes.
14.3. EU Online Dispute Resolution (ODR) Platform In accordance with EU consumer protection laws, consumers have the right to use the European Online Dispute Resolution (ODR) platform, operated by the European Commission. 14. THIRD-PARTY LINKS & SERVICES
One Mo Diamond may provide links to third-party websites and services, including but not limited to: Payment providers (e.g., Stripe, Mollie). Logistics and tracking platforms (e.g., DPD, UPS, DHL). External certification or gem grading services. One Mo Diamond is not responsible for the content, policies, or security of third-party websites. The use of third-party services is at the Buyer’s own risk, and the Buyer should review the respective service provider's Terms & Conditions before proceeding. Any disputes arising from third-party services must be resolved directly with the respective provider.
15. NO WAIVER CLAUSE
If One Mo Diamond does not immediately enforce any of its rights under these Terms and Conditions, this does not mean that we waive such rights. Failure to assert any rights in the event of a breach of contract does not prevent One Mo Diamond from enforcing them later. No waiver of any provision is valid unless expressly communicated in writing.
16. SEVERABILITY CLAUSE
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms and Conditions and all documents expressly referred to herein constitute the entire agreementbetween One Mo Diamond and the Buyer. Both parties acknowledge that neither party relies on any statements, warranties, or agreements not explicitly stated in these Terms and Conditions. Any liability for misrepresentation or verbal agreements is limited to breaches of this contract.
18. FINAL PROVISIONS
18.1. Amendments to Terms & Conditions One Mo Diamond reserves the right to modify these Terms and Conditions at any time. Any changes will be published on www.onemodiamond.com and take effect immediately upon posting. It is the responsibility of the Buyer to review the latest version of the Terms before making a purchase. If the Buyer places an order after changes have been made, it will be considered an acceptance of the updated Terms and Conditions.
18.2. Severability Clause If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or legal authority, the remaining provisions shall remain valid and enforceable. Failure by One Mo Diamond to enforce any provision of these Terms shall not be considered a waiver of its rights.
18.3. Official Communication All official communications related to these Terms and Conditions must be sent via email. 18.4. Agreement Acceptance & Effectiveness By using the website www.onemodiamond.com, the Buyer acknowledges and agrees to these Terms and Conditions. These Terms constitute a legally binding agreement from the moment the Buyer places an order on the website.
